Commentary by Attorney Michael Grossman

People tend to just overlook accidents like this because they assume OSHA has everything covered. It would surprise people how often OSHA went through their investigations, issued citations, collected fines, and still left a worker’s loved ones without any clear answers or solutions. The reality is OSHA’s purposes don’t really look out for the needs of a family.

That usually requires independent steps to navigate Texas work fatality law—the most complex work fatality laws in the whole country. There’s isn’t always a one-size-fits-all, automatic process for getting benefits or for seeing accountability. As such, families understandably tend to seek out alternative paths that put their needs first and foremost. It wouldn’t at all be unusual if similar steps were taken here.
