Commentary by Attorney Michael Grossman
Whenever I come across accidents like the one that tragically resulted in the loss of life on State Highway 59, my first concern is whether the affected families will get the answers they need about how and why this occurred. While initial reports often detail the basic facts, the complexity of a crash involving multiple vehicles and serious injuries means that thorough investigation is paramount. To that end, three critical questions must guide the inquiry.
First, did the authorities thoroughly investigate the crash? Multi-vehicle collisions like this one require careful accident reconstruction to untangle the sequence of events. What caused the Ford pickup to rear-end the first vehicle? Was the Dodge given any opportunity to avoid the collision, or did the Ford’s trajectory make it unavoidable? Investigators must also examine the crash site for contributing factors, such as visibility, road conditions, or signage. It’s essential to ensure that every detail of this chain-reaction event is meticulously reviewed to form a complete understanding of what occurred.
Second, has anyone looked into the possibility that a vehicle defect contributed to the crash? In a complex scenario like this, there are multiple opportunities for mechanical failure to play a role. Could a braking failure in the Ford pickup have caused or worsened the initial collision? Did the Dodge experience a stability issue that contributed to its overturning? A detailed forensic examination of the involved vehicles is critical to determine whether any mechanical or design defect played a role. Preserving all vehicles involved is crucial to this process, as vehicle defects are often overlooked without proper investigation.
Third, has all electronic data relating to the crash been collected? Modern vehicles equipped with electronic control modules (ECMs) store critical data, including speed, braking, and steering inputs leading up to the crash. This data could clarify how each driver responded during the incident. Additionally, cell phone records may reveal whether distractions were involved, and nearby traffic or surveillance cameras could provide visual confirmation of the sequence of events. Collecting this information promptly is vital to ensure no data is lost or overwritten.
For everyone affected by this crash, these questions are essential for finding clarity and, potentially, accountability. Understanding the causes of this tragic event is not just about closure—it’s about ensuring lessons are learned to prevent similar incidents in the future.
