Commentary by Attorney Michael Grossman
When someone is seriously injured in a single-vehicle crash during early morning hours, it can be challenging to keep all the facts straight. I’ve spoken to countless people involved in similar accidents whose major concern was they didn’t feel their side of the story was being considered fairly. Well, sometimes it isn’t. That’s why it can be important to gauge the efforts of authorities early on.
Did the authorities dedicate enough time, tools, and resources to the investigation?
Crashes on rural highways in the middle of the night don’t always get the full attention they deserve. Investigators should have documented the vehicle’s path, examined the roadway, and looked at any signs of sudden driver response. If those steps were skipped, key details may never be recovered.
Has anyone looked into the possibility that a vehicle defect caused the crash?
A sudden loss of control could point to a problem inside the vehicle—anything from a steering failure to a brake issue. It’s also possible for things like brake failure or seatbelt failure to result in serious injuries which otherwise could have been prevented. These possible factors are rarely visible without a detailed inspection, and that usually needs to be done as early as possible before any important evidence degrades or is destroyed.
Has all the electronic data relating to the crash been collected?
Most modern vehicles store valuable crash-related data—speed, steering, braking—that could help explain what happened. Phone or GPS records could also provide added context, and there may also be cameras from nearby buildings that caught the incident or moments before it on video. This information is also important to look at as promptly as possible.
Ultimately, these questions give authorities an opportunity to show how thorough they’ve been. If it seems they have satisfactory answers, it’s likely a sign of good investigations. But if their answers don’t quite add up, there may need to be another set of eyes looking things over to really get the whole story.
Takeaways:
- Single-vehicle crashes at night still require full documentation and review.
- Mechanical issues can’t be ruled out without a detailed inspection.
- Vehicle data can show key actions leading up to the crash.
