Commentary by Attorney Michael Grossman
One of the challenges with pedestrian accidents is that people often jump to conclusions. They assume everything comes down to who had the right of way. As important as that is, all possible factors need attention. How fast were the vehicles going? Are there issues with lighting or signage in this area? Was distracted driving involved? Was alcohol a factor? Likely or not, a proper investigation should be able to rule out these and other possible factors. If they can’t—or won’t—then the accident may need a second set of eyes to keep the facts straight. Otherwise, something important might slip through the cracks.
