Commentary by Attorney Michael Grossman

When a law enforcement vehicle strikes another motorist while responding to a call, the investigation has to account for more than just the urgency of the situation. Even during emergency responses, every vehicle—police or civilian—is still subject to the same physical limits and mechanical risks.

1. Did the authorities thoroughly investigate the crash?
When a crash involves a police cruiser and results in a rollover, there needs to be a detailed review of how both vehicles entered the intersection. Investigators should have mapped the approach speeds, traffic signal status, and timing of each vehicle’s movement. Whether the cruiser used lights and sirens is only part of the story—what matters most is whether all vehicles had the opportunity and ability to respond in time. If the scene wasn’t fully reconstructed, especially given the rollover, essential facts may still be missing.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Although the crash appears to be related to a response maneuver, it’s still important to evaluate whether any mechanical issue contributed. In either vehicle, brake failure, steering problems, or sensor misreads could have worsened the outcome. For the Toyota in particular, which rolled after impact, suspension integrity and rollover resistance should be reviewed. If mechanical inspections haven’t been done, the door remains open for overlooked contributors.

3. Has all the electronic data relating to the crash been collected?
Both the cruiser and the Toyota likely hold crucial digital evidence. Vehicle speed, braking effort, steering input, and even GPS activity can show exactly how the vehicles were moving before impact. That’s especially important in determining whether one or both drivers had time to react. Without this data, any assumptions about timing or driver behavior are just that—assumptions.

Crashes involving emergency vehicles must be treated with the same scrutiny as any other serious collision—maybe more—because accountability and clarity matter to everyone involved.

Takeaways:

  • Intersection crashes with emergency vehicles need full reconstruction, including traffic signal timing and vehicle movement.
  • Mechanical inspections of all vehicles should rule out defects that could have worsened the crash.
  • Electronic vehicle data helps determine how fast the vehicles were traveling and whether evasive actions were attempted.
