Commentary by Attorney Michael Grossman

When someone is seriously hurt in a single-vehicle rollover crash, people often assume the driver was simply going too fast or made an error in judgment. But in my experience, those kinds of assumptions can overlook critical factors that may have contributed to the crash. That’s why there are three questions that should always be asked.

First, did the authorities thoroughly investigate the crash? A rollover accident typically involves multiple forces, and understanding how the vehicle left the roadway—and whether the driver tried to correct course—requires more than a cursory glance. A complete investigation should document skid marks, steering input, roadway conditions, and any possible obstructions. Unfortunately, the level of detail in these investigations often depends on time and resources, which can vary from one agency to another.

Second, has anyone looked into the possibility of a vehicle defect? In rollovers involving pickup trucks, it’s especially important to consider the condition of the tires, suspension, and steering components. Something as seemingly minor as uneven tire pressure or a worn ball joint can result in sudden loss of control. But if the vehicle is released or scrapped before a thorough mechanical inspection, any such defect may never come to light.

Finally, has all available electronic data from the vehicle been preserved? Most modern pickups are equipped with event data recorders—commonly known as black boxes—that can show what the vehicle was doing just before the crash. That includes speed, throttle, brake use, and steering input. This data can confirm or challenge assumptions about what the driver did and how the vehicle responded.

Understanding how and why a crash happened is essential—especially when someone has been seriously hurt. The answers don’t always come easily, but they can’t be found unless the right questions are pursued from the start. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
