Commentary by Attorney Michael Grossman

There isn’t a lot of information about what happened here, but a common misconception I’ve dealt with repeatedly throughout my career is the false belief that someone who rear-ends another vehicle is automatically at fault. That’s simply not how the law works. It’s of course important to know why the collision happened.

Like in a case I handled not long ago, an 18-wheeler recklessly merged directly into the path of someone on a busy highway. That driver wasn’t simply in the clear just because the victim hit their rear-end. They were responsible for their own reckless actions. Maybe that isn’t what happened here, but it’s the reason crashes like this still need proper, thorough accident investigations. If nothing else, there is a family out there that deserves answers—not mere hasty assumptions.
