Commentary by Attorney Michael Grossman

Allegations of drunk driving are serious enough on their own, but that alleged drunk driver being a teenager is even more concerning. This brings up something crucial I talk about after any alcohol-related accident: Where did the driver get the alcohol from?

Obviously, serving someone under the legal drinking age warrants consequences. Beyond that, though, alcohol providers can be in trouble if they unlawfully over-serve someone. These consequences can include criminal investigations, fines, and even liability for the resulting injuries. In my experience, a reckless alcohol provider willing to break the rules is likely breaking all kinds of rules. I’ve handled hundreds of cases against negligent alcohol providers who contributed to an accident, and serving minors and over-serving people is often just the tip of the iceberg.

With that in mind, are authorities being thorough in their investigations here? A teenager being under the influence of alcohol certainly warrants consequences, but that could be only half of the larger story. That alcohol came from somewhere, and there’s a very serious possibility there’s an accomplice to all of this who unlawfully provided that alcohol. The sooner that possibility gets attention, the sooner there can be appropriate consequences for the resulting accident.
