Commentary by Attorney Michael Grossman
With someone being accused of failure to yield, it may seem like things are open-and-shut. I can’t begin to count how often I’ve had calls from folks involved in similar situations who waited patiently for a police report only to end up with unclear or incomplete reports. That’s why it can be crucial to consider a few key factors about official investigations.
Did authorities dedicate the time, tools, and experienced officers to thoroughly investigate the crash? Digging through all of that evidence takes time, and not all departments are willing to divert that sort of effort.
Did authorities analyze the vehicle for defects? Likely or not, they can cause crashes or fail to prevent injuries, making accidents more serious than they need to be. This can take extensive investigations from trained specialists.
Finally, have authorities secured all electronic evidence? Whether it’s Engine Control Module data from the vehicles, cellphone data from the drivers, or video evidence from nearby businesses or residences, securing this sort of time-sensitive evidence is key to any investigation.
If authorities can’t provide answers that show they’ve considered these important possible factors, that can be a family’s sign that the crash may be better off in the hands of independent investigators.
