Commentary by Attorney Michael Grossman
An early morning crash can present significant challenges. Not only is there not likely to be a lot of witnesses, the crash scene itself can present more hurdles for the authorities. This sometimes makes them overlook important information. I’ve found it’s helpful, then, to follow up on authorities’ efforts.
Did investigators have the time, tools, and training to properly examine the crash? Serious accidents require detailed reconstructions, but limited resources or other priorities may lead to rushed or incomplete investigations. Were road conditions, lighting, or possible evasive maneuvers carefully analyzed, or did authorities make assumptions about what happened?
Did they check for potential vehicle defects? A sudden loss of control could be due to mechanical failures like brake malfunctions, steering issues, or tire blowouts. Additionally, if airbags or seatbelts failed, the crash may have been more severe than it should have been. Was the vehicle inspected before critical evidence was lost?
Did they preserve all available electronic evidence? The vehicle’s Engine Control Module (ECM) may contain key data on speed, braking, and steering inputs before impact. GPS data, cellphone records, and any nearby surveillance footage could also provide valuable insights. Have investigators taken steps to secure this information?
If authorities can’t provide clear answers, that could be a sign they’re not giving the accident the attention it needs. If they can provide clear answers, that likely means they’re doing good, thorough investigations. At the end of the day, it’s up to the family to determine if their concerns are being adequately addressed and to seek out alternative avenues if authorities can’t meet their needs.
