Commentary by Attorney Michael Grossman

The pedestrian crash on Gillespie Street in Dallas underscores the importance of a thorough investigation to determine how and why this incident occurred. While the driver remained at the scene, the circumstances surrounding the collision must be carefully examined to ensure all contributing factors are understood. To do so effectively, investigators should focus on three critical questions.

First, did authorities conduct a comprehensive investigation of the crash scene? Pedestrian crashes often involve complex dynamics that require careful analysis. Investigators should assess the roadway for factors such as lighting, visibility and any obstructions that may have limited the driver’s ability to see the pedestrians. Did the position of the parked rideshare vehicle contribute to the collision by obstructing the view or narrowing the roadway? Documenting the speed and trajectory of the moving vehicle and the pedestrians’ movements is essential to understanding how the crash unfolded.

Second, has anyone considered whether a mechanical issue in the vehicle may have played a role in the collision? While the circumstances suggest that the driver pulled around the parked car, it’s still important to examine whether the vehicle was functioning as intended. A failure in the steering or braking systems could have impacted the driver’s ability to avoid the pedestrians. Conducting a forensic examination of the vehicle is critical to identifying any mechanical issues or maintenance problems that may have contributed to the crash.

Finally, has all electronic data related to the crash been collected? The vehicle involved is likely equipped with an engine control module (ECM) that can provide key information, such as speed, braking and steering inputs, leading up to the collision. This data could clarify whether the driver attempted evasive action or if the vehicle responded as expected. Additionally, any available video footage from traffic cameras, surveillance systems or dashcams in the area should be reviewed. Cell phone records for the driver may also help determine if distraction played a role in the incident.

Every pedestrian crash deserves a detailed and impartial investigation to ensure all factors are accounted for and all parties involved have the answers they need. By addressing these three questions, investigators can work toward providing clarity and accountability for all those impacted by this crash.
