Commentary by Attorney Michael Grossman

When people see an alleged drunk driver potentially facing charges after an accident, they’re generally quick to assume the whole situation is open-and-shut. However, there could be more to the story than just a single reckless driver. It’s possible that driver was unlawfully over-served by a negligent alcohol provider, and they, too, could be responsible for the accident.

Simply put, it’s unlawful in Texas for bars, restaurants, liquor stores, and other venues to serve someone who is obviously intoxicated. Doing so can expose those providers to consequences, especially if that over-service leads to people being hurt or killed in an accident.

So while it’s obviously important to ensure drunk drivers are held accountable for their actions, investigations can’t end there. Investigators need to say what all led up to this accident and whether or not there were any accomplices who need to answer for their actions. Not only do victims and families deserve to see accountability after a serious accident, but there may even be a path to help ensure this sort of thing doesn’t happen again.
