There is supposed to be a stop sign at the intersection for southbound traffic in order for highway traffic to maintain the right of way; however, for as yet unknown reasons, the stop sign at the intersection was missing at the time of the accident. As a result, the Impala entered the intersection at an unsafe time, leading to a collision between its front-left side and the front-right of a westbound Nissan Titan pickup truck occupied by a 27-year-old woman.

Fitzpatrick incurred reportedly critical injuries as a result of the wreck. The woman from the pickup truck sustained moderate injuries, as well.
