Commentary by Attorney Michael Grossman
I have to wonder if the lack of public information about this crash is due to authorities being tight-lipped or rather not up to the task of conducting a thorough investigation. Folks tend to assume authorities have crack CSI teams on a crash scene to get all the facts. In reality, a lot of departments don’t even have the tools or training to do thorough accident reconstructions.
Unfortunately, accident reconstruction is just not a high priority for a lot of departments. Officers can generally handle simple or straight-forward accidents, and they can look into things like cell phone usage or drunk driving. But getting the full story often involves ruling out mechanical issues and road design flaws, investigating negligent alcohol providers who may have illegally over-served a driver, checking for manufacturing defects with the vehicles, etc. Without proper tools and special training, that stuff easily slips through the cracks.
That’s why more prudent departments often enlist the aid of independent accident reconstructionists who can pick up where authorities fall short. My experience with independent investigators is that they’re incredibly thorough, they look into even unlikely possible factors, and they can distinguish between factors that caused the crash versus factors that caused the injuries (which aren’t always the same). Perhaps steps have been taken here to have experienced eyes look over the crash. If not, there could be a lot to this story the victims and families still don’t know about.
