Commentary by Attorney Michael Grossman

Currently, it’s alleged that the Nissan driver had been drinking. This hasn’t been confirmed yet, but it does present rather unique challenges after a crash like this. Folks tend to only consider crashes in terms of the drivers involved. But there can be outside parties involved, as well. With alcohol, that outside party could be a local alcohol provider.

Simply put, it’s illegal in Texas for alcohol providers to over-serve someone who is obviously intoxicated, and they can be liable if that person gets themselves or someone else injured. Despite this, it’s not the sort of thing authorities typically address on their own. I’ve handled hundreds of cases against alcohol providers, and our investigations are often the only ones happening. That’s why it’s important to shine a light on this area of the law so folks know their rights and have the tools to consider what avenue is best to get them back on their feet after a serious accident.
