Commentary by Attorney Michael Grossman

Anytime I see an accident like this, it immediately raises questions about more than just driver error. In my experience handling hundreds of commercial vehicle accident cases, these kinds of decisions are often influenced by the environment a driver’s employer creates. Was the driver under pressure to complete a delivery on a tight timeline? Did they have proper training on how to safely handle a commercial truck? Was this someone the company thoroughly vetted before hiring, or did they overlook red flags in the driver’s history just to get a seat filled?

Working conditions can play a major role in situations like this. Some companies create a culture where getting the job done quickly matters more than getting it done safely. That can lead to rushed decisions, shortcuts, and risky behavior—especially in early morning hours when fatigue and visibility are major factors. If a driver is operating under unrealistic expectations or without proper oversight, then their employer may bear responsibility for the harm resulting from those oversights.

That’s why it’s essential that investigations go beyond just what happened in the crash itself. There are plenty of times where mistakes happened long before a driver ever got behind the wheel that need to be brought to light. Otherwise, there’s a real danger that those issues could harm others in the future.
