Commentary by Attorney Michael Grossman
There are a lot of questions about this car accident right now because authorities have not released a lot of information yet, but the reported involvement of a tow truck raises unique questions. Often, crash investigations don’t delve beyond surface-level causes, especially when commercial vehicles are involved.
Was the tow truck actively towing at the time? Was the investigation thorough enough to evaluate mechanical factors, driver actions and company policies? Did investigators preserve critical data like engine control module readings, surveillance video from nearby businesses or cellphone activity logs that could have revealed what happened in the moments before the crash?
In my opinion, there are still a lot of questions to answer in this case that authorities don’t always have the time, training, or equipment to properly investigate. That’s why in many of the cases I’ve handled, commercial vehicle accidents fare better in the hands of independent investigators. There’s no reason right now to think this crash would be an exception.
