Commentary by Attorney Michael Grossman
It might surprise people to learn that a crash like this can be quite challenging for those involved. The fact that only the passenger had reported injuries sometimes leads authorities to overlook important details. Their priorities tend to revolve around drivers and looking for chargeable offenses. Those efforts don’t necessarily align with victims in need of help after a crash, which is why independent investigators sometimes need to be involved.
Simply put, a crash like this may require investigations into factors not necessarily relating to a driver’s actions. Did a tire blow out? Did airbags and seatbelts function properly? Was the driver unlawfully over-served by an alcohol provider? Does the roadway lack proper signage or lighting? I’ve had countless cases where authorities completely overlooked these possible factors, and it took independent accident reconstructions to fill in the gaps. It wouldn’t be unusual if similar efforts proved necessary here, as well.
