Commentary by Attorney Michael Grossman

When it comes to car accidents, people tend to think authorities gather all of the evidence, bring the whole story to light, and that’s that. In reality, even single-vehicle wrecks like this can present unique challenges. Right now, details say the driver made an evasive maneuver, so finding out why that happened is obviously important. But there is sometimes another aspect to serious accidents: finding out what caused the injuries.

I had a case not long ago that’s a clear example of this. Police were so focused on looking over the driver’s actions that they didn’t realize how unusual it was that the victim was severely injured in a relatively moderate crash. They assumed the driver hadn’t been wearing their seatbelt, but the family knew the victim would never forget such a thing. We had more thorough independent accident reconstructionists look the car over, and it turned out the driver’s seatbelt was defective and failed during the accident.

Simply put, that’s the sort of thing a typical police investigation rarely looks into. Maybe authorities here were more thorough, but it’s just not the sort of thing one should ever take for granted. Even when an accident may seem simple, there could always be more to the story that needs more thorough investigations.
