Commentary by Attorney Michael Grossman
Crashes that happen while passing a commercial truck raise important questions about visibility, lane positioning, and whether either driver had enough space to maneuver safely. In this case, reports indicate that a car clipped the back of a box truck while trying to pass on Interstate 80, causing the vehicle to spin out. A full investigation should determine whether this was due to driver misjudgment, road conditions or another contributing factor.
One of the first questions investigators should answer is whether the car had enough room to complete the pass safely. Reviewing black box data, dashcam footage and any available witness statements will be key in understanding how close the vehicles were before the collision.
Another key factor is whether visibility played a role. Passing a large truck at night can be more difficult due to blind spots and reduced lighting. Did the car driver have a clear view of the truck’s rear and sides? Was the truck properly marked with reflective tape and functioning taillights? If visibility was a factor, investigators should consider whether additional safety measures, such as better highway lighting or truck safety markings, could have prevented the crash.
Road and traffic conditions should also be considered. Was the highway congested, limiting the amount of space available for passing? Was the road wet or icy, making control more difficult after the initial impact? If external factors contributed, they should be examined closely.
At this stage, there isn’t enough public information to determine exactly what led to this crash. But if authorities focus only on who hit whom without investigating why the passing maneuver led to a collision — whether due to driver misjudgment, truck positioning or road conditions — they risk missing key details. A thorough investigation should take all possible factors into account to ensure a full understanding of what went wrong.
