Commentary by Attorney Michael Grossman

Even if these allegations are true, a truck driver being under the influence of alcohol doesn’t likely make things simple. Why is that? Well, I’ve handled hundreds of commercial vehicle accident cases, and they often involve mistakes that happened before the truck driver ever got behind the wheel. That isn’t always within the scope of typical police efforts. In fact, with a driver potentially facing serious charges, they may consider this case open-and-shut before they’ve looked into all relevant contributing factors. That’s why many accidents like this end up needing more thorough investigations from professionals independent of the authorities.

For example, a commercial truck driver doesn’t likely just wake up one day and decide to get to black-out levels of drunk. More often, there is a pattern of behavior or a history of issues that a responsible employer would be able to catch. Reputable trucking companies know there needs to be basic oversight, rigorous background checks, and regular testing to ensure their drivers can continue doing their jobs safely. Less responsible trucking companies, though, just want trucks and product moving. They skip background checks, hire unqualified or reckless drivers, and otherwise fail to supervise drivers so long as they’re hitting their deadlines and quotas. This inevitably leads to drivers making reckless decisions and causing entirely preventable accidents.

So, could it be that this all was the result of a rogue, reckless individual truck driver? Absolutely. But if there were steps that could have prevented all of this chaos, it’s important there is accountability for the ones who failed to take those steps. It’s possible authorities are conducting thorough enough investigations to say one way or the other. More likely, though, there’s a lot more to this story than preliminary reports suggest. Generally speaking, if victims and families want to move toward a fair resolution after a serious accident like this, steps have to be taken as soon as possible to ensure those possibilities are getting the attention they need.
