Commentary by Attorney Michael Grossman

There are a lot of unknowns about this Smith County crash at this point, likely because the investigation is still ongoing, but a crash involving four vehicles and a rollover demands a robust investigation.

In my three decades as an attorney, I’ve seen a lot of investigations, some of the excellent, others not quite up to snuff. What is the difference?

When an investigation is done correctly, investigators reconstruct events leading up the collision, interview witnesses, and gather all the electronic data that may be relevant to figuring out what happened. The most important source of data is usually from the engine control module data of the involved vehicles, as well as dashcam footage or video from nearby businesses and residences that may have captured the crash. Investigators should also consider the possibility that a vehicle defect may have led to the crash.

If investigators do all of that, what results is a thorough picture of the crash that answers any questions those involved may have about how the crash occurred and who is ultimately responsible. Of course, this doesn’t always happen. In these cases, it is often necessary for those affected by the crash to make arrangements to have a second set of eyes perform the steps that authorities missed.
