Commentary by Attorney Michael Grossman
When accidents like this occur, it’s natural for people to assume it’s based solely on driver error. However, in my experience, incidents involving large trucks often have deeper causes that require thorough investigation.
In this case, it’s crucial to consider what led to the 18-wheeler’s failure to control its speed. Was the driver distracted, fatigued, or perhaps dealing with a mechanical issue that impaired the truck’s ability to stop in time? Factors such as brake condition, tire quality, and the truck’s load weight could have played significant roles in this crash. Additionally, the driver’s schedule and hours behind the wheel before the accident should be scrutinized to determine if fatigue or other issues might have contributed to the situation.
Truck maintenance is another critical aspect that must be examined. Regular maintenance is essential to ensuring that a truck’s braking system, tires, and other vital components are in optimal condition. If the truck involved in this accident wasn’t properly maintained, it could have contributed to the driver’s inability to stop in time, potentially implicating the trucking company in the crash. The responsibility for maintaining a safe vehicle extends beyond the driver to the company that owns and operates the truck, and any lapse in this area can have catastrophic consequences.
If the truck was operating under a commercial trucking company, it’s also important to consider the company’s role in ensuring safety. Companies are responsible for training their drivers, maintaining their vehicles, and scheduling routes that allow for adequate rest and adherence to safety regulations. Any shortcomings in these areas could suggest that the company shares responsibility for the incident.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
