Commentary by Attorney Michael Grossman
Authorities said drugs may have been a factor, and they recommended a charge for intoxication assault. If those allegations are true, then it wouldn’t be all that surprising. Just about every personal injury case I’ve handled over the years involved intoxicated drivers (usually drunk drivers). The question is if authorities were thorough enough to consider what the intoxicants were, where the driver was coming from, and whether or not there is more to this than simply charging a reckless driver and moving on. I know if someone drove without headlights head-on into my car, I’d want to know every step was being taken to address the situation properly.
