Commentary by Attorney Michael Grossman

Right now, the cause of the crash remains unclear. Something that may surprise people, though, is that’s often just one aspect of a serious crash. Investigators who make sure to consider all possibilities—even unlikely ones—sometimes find the cause of the crash and the cause of the injuries are quite different.

For example, I was discussing an accident with a colleague recently where a woman’s vehicle crashed into a semi-truck. Authorities blamed the crash on distracted driving, so that seemed like the end of the matter. However, it stood out that the woman’s injuries were quite serious despite a relatively minor collision. What happened? Well, more thorough independent accident reconstructions revealed she had a defective airbag no one knew about. Had it not been for the defect, she likely would have been fine.

That’s a rather unusual scenario, and I’m not saying it happened here. But it’s happened before, so it should at least be ruled out. My concern with single-vehicle wrecks is authorities may not see them as a high enough priority to really do that. Were investigators here more thorough?
