Houston, TX — June 21, 2024, Ana Argueta, Edgar Thomas Jr. and multiple minors were hurt due to an alleged drunk driver accident at 8:15 p.m. on Loop 610.

Initial details released about the accident say that it happened at the intersection of the eastbound Interstate 610 service road and Cullen Boulevard.

According to officials, 61-year-old Ana Argueta was in a Ford Escape facing eastbound on the service road at the Cullen light. 44-year-old Edgar Thomas Jr. was in a Ford Focus going northbound. As Thomas approached the intersection, a Dodge Ram pickup rear-ended Thomas, then veered left across oncoming lanes. The pickup then went onto the service road and crashed into the side of Argueta’s vehicle.

Commentary by Attorney Michael Grossman

Typically, authorities will be quick to pursue charges against someone who allegedly caused a crash while drunk driving. It’s a bit unusual they made no mention of that yet, though it’s possible they’re looking into factors beyond the immediate crash scene. For example, it’s important in these situations to find out where a drunk driver got their alcohol, as those alcohol providers can be responsible if they unlawfully over-served the driver and contributed to the accident. That said, this isn’t something that’s usually on the police’s radar.

I had this one case not long ago, for instance, where a family just wanted a second set of eyes on their situation after a drunk driver hit them head-on, nearly killing a young boy. Authorities hadn’t even bothered looking into where the alcohol came from. If they had, they would have found what we did—an establishment breaking the law and pouring drink after drink for someone who was clearly a danger to others. Had it not been for the family wisely deciding that the authorities alone weren’t giving them the whole story, that establishment may have been let off the hook for their role in seriously injuring a young kid.

So it could be that authorities here left initial statements vague because they had more they wanted to investigate. It could also be, however, that this is one of those situations where they unfortunately don’t take things seriously and let important details slip through the cracks. That’s one of the reasons it’s important people understand the different legal avenues that can be available to them. If and when efforts by authorities prove to be fruitless, there can be measures in place to ensure the victims and families still see a proper resolution.
