Allegations of intoxicated driving are obviously serious, and the charges recommended by authorities here are rather serious, as well. But the story doesn’t likely end there. Even if authorities feel that their work is done, there could be more to all of this if the alleged intoxicated driver was unlawfully over-served by an alcohol provider. Let me explain.
In Texas, alcohol providers can be responsible if they over-serve someone who is obviously intoxicated. This can include potential criminal investigations, fines, suspended licenses, or liability for victims’ injuries caused by that intoxication. Not only do these avenues allow for negligent establishments to face accountability, but also it can help get them to clean up their act so others aren’t harmed in the future.
Unfortunately, this is something that too often slips through the cracks. I’ve handled hundreds of cases caused by intoxicated drivers. I rarely see authorities take their own steps to investigate potentially negligent alcohol providers. They usually only do so when there are independent investigators like me and my team directly calling out those complicit alcohol providers, essentially handing evidence to authorities on a silver platter.
It’s possible authorities here have been more thorough behind the scenes. Or, evidence may show this all happened due to a single, reckless individual. However, victims and their loved ones deserve to know that all who put hardship on them are facing appropriate consequences. If authorities are too narrow in their investigations, that may not happen.
