Commentary by Attorney Michael Grossman

There isn’t a lot of information about this crash available right now, but people might assume everything is open-and-shut. Investigators will find out who’s to blame, and that’ll be that. However, the fact the injured party here appears to have been a passenger, it brings up an interesting aspect of the law. Simply put, a proper investigation should consider the actions of both drivers. Here’s why.

To sum up a lot of legalese, a person or people who contribute to the cause of an accident are responsible for their portion of the blame so long as the victim of that accident wasn’t the one primarily responsible for their own injuries. In other words, unless there’s some highly unlikely scenario where a passenger causes a car crash, it’s very likely one or more people are responsible for the victim’s resulting injuries.

Depending on the circumstances of this particular accident, it could be that both drivers did something wrong. Maybe it was all just one driver. Or, this could be some one-in-a-million crash where an outside 3rd party (the manufacturer of a defective part, for example) is responsible. The point is that treating an accident as simple is bound to result in sub-par investigations that can miss important details. Ensuring investigations are as thorough as possible helps to ensure there will be full accountability for the harm the victim suffered.
