Generally speaking, folks tend to assume that alcohol-related accidents are always open-and-shut. In reality, they can be incredibly complex if handled properly. This is because a lot of drunk drivers are unlawfully over-served by alcohol providers, and they, too, can be held accountable. Unfortunately, authorities tend to overlook them.
Simply put, alcohol providers who serve someone that is obviously intoxicated can potentially face criminal investigations, fines, suspended licenses, and liability if the intoxication gets people hurt or killed. Authorities, though, can get tunnel vision if there is already someone to charge. I’ve handled hundreds of alcohol-related accident cases, and I can’t count how many times authorities charged a driver, moved on, and left a negligent alcohol provider out there continuing to break the law and put the community at risk.
So while it’s not clear what all happened here, there’s no reason to believe this accident will be any less complex than other alcohol-related crashes. At the very least, making sure the victims and families involved have clear answers is challenging enough on its own.
