A crash involving a FedEx delivery truck and a pickup truck left one person dead Thursday afternoon on Highway 181 in Burke County, North Carolina.

According to the North Carolina State Highway Patrol, the collision occurred around 1:30 p.m. in the Oak Hill community. Authorities allege the FedEx truck pulled into the path of a southbound pickup truck, causing the pickup to overturn and crash into a guardrail. The driver of the pickup, 67-year-old Rex Ivy Powell, died at the scene. The FedEx driver suffered minor injuries and was later charged with misdemeanor death by vehicle and failure to yield the right of way.

Whenever I hear about a fatal crash involving a commercial delivery vehicle, I think about how vital it is for commercial drivers, especially those operating on local roads, to exercise caution and follow the rules of the road when entering traffic. In my experience, crashes like this often involve questions about driver awareness, decision-making, and whether the commercial vehicle was operated as safely as required.

Could Distraction or Fatigue Have Played a Role in the FedEx Driver’s Failure to Yield?

When a commercial vehicle enters the path of oncoming traffic, investigators need to ask whether the driver was paying attention. Distraction is a leading cause of right-of-way violations in crashes involving commercial trucks and vans, especially in local delivery operations where frequent stops, schedule pressure, and in-cab devices can divert attention from the road.

Fatigue may also have been a factor, particularly for drivers operating under time pressure or long shifts. Investigators should review the FedEx driver’s work schedule, hours of service, and any in-cab or dash cam video to determine whether distraction or fatigue prevented proper judgment and reaction when pulling into the roadway.

What Evidence Should Be Examined?

To fully understand how this crash happened, investigators should collect any dash cam footage, GPS data, and witness statements to determine the movement of the FedEx truck at the time of the crash. Scene evidence, including tire marks, vehicle positions, and impact angles, will also help establish how much time the FedEx driver had to yield and whether evasive action was attempted.

Why Thorough Investigation Is Important in Commercial Vehicle Crashes

From my experience, fatal crashes involving commercial vehicles on local roadways are rarely simple. They often involve a mix of human error, possible distraction, and sometimes mechanical issues that all must be carefully reviewed. Whether this accident was caused by distraction, poor judgment, or another factor, only a thorough investigation will provide clear answers on why the crash happened in the first place.
