Commentary by Attorney Michael Grossman
It should raise flags for investigators anytime only one person involved in an accident is seriously injured while everyone else seems to be okay. While not exactly common, this can sometimes be a sign of a vehicle defect. If, for example, a seatbelt or airbag fails, a person may be more severely injured than they should be, regardless of what led to the actual accident. That often takes thorough independent investigations to rule out, so it wouldn’t be unusual if authorities overlooked that possibility here.
