Commentary by Attorney Michael Grossman

If it’s true that the vehicle here failed to yield to the victim, that would be crucial evidence to secure. A lot of people are quick to blame pedestrians, so any evidence to the contrary is vital to preserve. People tend to assume authorities are on top of that, but I’ve had plenty of cases where their investigations fell short.

Video footage, for example, seems like an obvious factor to look into these days. A lot residences and businesses alike have cameras facing the street which can prove crucial to an investigation. In a case I handled, though, the officer investigating the accident was so quick to move on to another job that he never bothered looking for nearby cameras. Once the family brought us on the case, it took no time at all to canvas the nearby businesses, and we found one that a clear video of the entire incident.

It’s possible authorities here have been more thorough. My point is simply that taking that for granted isn’t usually prudent. It’s best to be proactive and make sure investigations are being handled properly. That way, if it seems like authorities are leaving gaps in the story, there can be steps taken to fill in those gaps.
