How Did This Accident Occur?

When accidents like this occur, people are quick to assume that they are caused by driver error. I’m not saying that’s not a safe bet. Human error—whether caused by distraction, fatigue, impairment, or something else entirely—plays a role in the majority of car accidents. But I’ve been in this line of business for over three decades. In that time, I’ve seen plenty of similar cases in which evidence of less likely causes ended up being unearthed by the investigation. That is why I hesitate to jump to concusions.

That’s not to say that I know more than anyone else about this specific accident outside of the investigation. I just want to point out that, hypothetically, the Accord’s excessive speed could have been caused by something like brake failure or a throttle problem. I understand that it’s not super likely, but neither is it outside of the realm of possibilities, so it still merits being looked into.

An in-depth vehicle inspection done by a trained professional in a laboratory setting would be able to bring to light any mechanical malfunctions or product defects that played a role which might otherwise have flown under the radar. Hopefully investigators—whether the authorities or a third party—get one done. After all, the victim deserves to have real answers about how and why this accident occurred backed by solid evidence. Vague assumptions based on surface-level investigation that just cases all the blame on his shoulders just won’t cut it.
