How Did This Accident Occur?
A motorcycle crashing into a slowing vehicle can happen for a number of reasons, though people may be quick to automatically assume the motorcyclist was in the wrong. Unfortunately, motorcyclists get a really bad rap. But I’ve worked with many motorcyclists and their families over the years. Most of them are very responsible drivers who end up being blamed for things they had no control over.
Here, for example, did the livestock trailer have working brake lights? Did the truck use their turn signal properly? Did the motorcycle have any unknown mechanical issues? Are accidents common on this stretch of road due to poor signage or an unsafe speed limit? Common or not, these are examples of things I’ve seen cause motorcycle wrecks before, and they can happen again. As such, they need to be included in a proper accident reconstruction, even if it’s just to rule things out.
Is it possible this all happened due to something more common, like distraction or unsafe speeds? Of course, and I wouldn’t pretend otherwise. But I’ve seen firsthand how hard it can be for a family when people rush to blame their loved one, and their loved one isn’t around to tell their side of the story. That’s why it’s important to focus on gathering evidence and letting the facts tell the story.
