Monica Bigham Intoxicated Driver Accident in Henderson County, TX

Investigators said that 49-year-old Monica Bigham was in a Nissan Frontier going eastbound along the highway. A Dodge Charger going the same direction reportedly turned left from the right lane, hitting Bigham’s vehicle in the process. This caused the Frontier to overturn along the median.

As a result of the crash, Bigham was killed. No other injuries were reported. Authorities say they believe the Dodge driver was under the influence of drugs at the time, and they recommended a charge for intoxication manslaughter.

Commentary by Attorney Michael Grossman

Since there isn’t much more information in these preliminary statements, I have to hope steps were taken to conduct thorough accident reconstructions here. People might think allegations of driving under the influence of drugs would make things open-and-shut. That isn’t always true. Simply put, the evidence authorities need to file criminal charges and the evidence a family needs to successfully resolve a fatal car wreck don’t always align. If authorities only prioritize pursuing charges, they may leave the family out in the wind to look for their own evidence. Maybe authorities here were thorough enough to cover both aspects of the accident investigation, but it wouldn’t be unusual if there was evidence left on the cutting room floor that required more thorough independent investigations.
