Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope the injured rider is receiving the care he needs and that investigators are taking the time to understand exactly what caused this incident. A motorcycle crash involving a curb impact may seem relatively simple at first glance, but in my experience, these events often result from a combination of environmental, mechanical and situational factors. To fully understand what happened on Yukon Road, we need to ask three critical questions.

First, did the authorities thoroughly investigate the crash? Motorcycle riders have far less margin for error than those in passenger vehicles, and something as minor as uneven pavement, loose gravel or a poorly marked curve can have devastating consequences. Was the curb clearly visible and adequately marked? Was the road surface in good condition, or were there factors that could have compromised the rider’s ability to maintain control? Investigators should thoroughly examine the roadway design, signage, lighting and any potential hazards at the crash location to determine whether the environment played a role.

Second, has anyone considered whether a vehicle defect may have contributed to the crash? The 2019 Harley-Davidson FLHXS should be inspected for issues that may have interfered with the rider’s control. Problems with the braking system, suspension or tires can significantly impair a motorcyclist’s ability to navigate safely, especially if a sudden maneuver is required. Even a small defect in the bike’s handling or stability systems can lead to a loss of control when interacting with something like a curb. Unless the motorcycle is preserved and examined, these potential contributors might go unnoticed.

Finally, has all the electronic or digital data related to the crash been collected? While motorcycles generally don’t contain traditional event data recorders, many modern bikes, especially touring models like the FLHXS, may have GPS or ride-monitoring systems that log location, speed and movement patterns. Additionally, on-bike recorders, if used, could offer critical insight into what the rider saw and how the bike responded. If any nearby surveillance cameras or witnesses exist, they could also help reconstruct what happened. Preserving this kind of evidence is time-sensitive and often essential to building a complete picture.

Crashes like this demand more than a surface-level assumption about rider error. A man was seriously injured, and his family deserves to know whether that outcome was the result of an honest mistake, or if something in the road, the environment or the motorcycle itself played a role. Only by asking the right questions and gathering the right evidence can we ensure that those affected receive the clarity and accountability they deserve.
