Commentary by Attorney Michael Grossman
If what authorities say here is true, then these details seem pretty straight-forward. But there really aren’t simple or straight-forward commercial vehicle accidents. This is because investigations need to consider both a driver’s actions and the actions of their employer. However, I’ve handled hundreds of commercial vehicle accident cases, and that’s not something anyone should take for granted. Too often, authorities let negligent companies slip through the cracks.
For example, the behavior described in this accident seems incredibly irresponsible. So why did the truck driver think it was okay to back up? Were they just not paying attention? Were they on their phone? Are they inexperienced? Did the trucking company hire someone with a history of reckless behavior? Was the driver in a hurry because their employer expected them to meet unreasonable deadlines?
These are just a few examples of questions that need answers to ensure that no one is wrongfully let off the hook. In my experience, that’s the sort of resolution people want. They don’t just want some bad guy to blame, and they don’t want to settle for an easy but incomplete explanation. They want to be sure there will be accountability for the wrongs done to them, and that means getting all of the facts. Whether or not authorities have taken those steps here remains to be seen.
