According to authorities, 40-year-old Joel Aguilar was traveling in a northeast bound Toyota Tacoma pickup truck on F.M. 168 in the vicinity southwest of the Buffalo Lake Road intersection when the accident took place. Officials indicate that, for as yet unknown reasons, the pickup was allegedly traveling at unsafe speeds. It was subsequently involved in a single-vehicle collision in which it apparently struck a fence and overturned.

Aguilar reportedly sustained serious injuries over the course of the accident. Additional details pertaining to this incident are not available at this point in time. The investigation is currently ongoing.

How Did This Accident Occur?

I’m sure many people will take one glance at this accident and dismiss it as having been caused by driver error. Is that a possibility? Sure. Human error—whether it was caused by distraction, fatigue, impairment, or something else altogether—plays a role in the majority of car accidents. However, I’ve been in this line of business for over three decades. In that time, I’ve seen plenty of similar cases in which evidence of less likely causes ended up being unearthed by the investigation. That is why I’m slow to jump to conclusions.

By the way, I’m not insinuating that I know more specifics about this accident than anyone else outside of the investigation. I just want to point out that, hypothetically, the pickup’s excessive speed could have been caused by something like brake failure or a throttle issue. On top of that, there is the fact that the vehicle overturned. Most people don’t know this, but the rollover tests that car manufacturers are required to pass don’t actually do a very good job of simulating real-world scenarios. I would be interested to know whether or not a design flaw contributed to the fact that the pickup overturned. Why? Because the victim’s injuries might not have been so severe had the vehicle managed to remain safely upright.

An in-depth vehicle inspection done by a trained professional in a laboratory setting would be able to bring to light any mechanical malfunctions, product defects, or design flaws that played a role in the wreck, rather than allowing them to fly under the radar. Hopefully, the investigators—whether the authorities or a third party—get one done. After all, the people affected by this accident deserve real answers backed by solid evidence. Vague assumptions based on surface-level investigation that conveniently place all the blame on the victim won’t cut it.
