Right now, additional details about the accident are unavailable. What is available, though, is incredibly concerning. While I can’t say one way or another what the evidence will ultimately say here, a trailer sticking out into traffic is almost never safe. I have to wonder if there might be other clues that could show whether the truck driver is responsible for this fatal accident.

Getting those answers, quite frankly, is rarely ever simple. There are almost always hurdles between families and getting the whole story. For example, there was a crash I handled a while back where an 18-wheeler was blocking lanes of travel, and someone crashed into the trailer. The trucking company was blaming the victim, saying they were speeding and not wearing their seatbelt. Well, our independent investigations into the crash proved otherwise.

According to a reconstruction of the scene and data pulled from the victim’s car, there was no sign that the victim had been speeding. Additionally, emergency responders testified they had to cut through the victim’s seatbelt to get them out of the wreckage. And to drive things home, our investigations showed the trailer’s reflective tape was so dirty that it was practically invisible and therefore useless.

It was only after gathering all of that undeniable evidence that the family was able to get the closure they deserved. So here, I can’t help wondering what steps were taken to reconstruct the scene and bring to light the various factors that may have played a role in the crash. It’s possible this was all unavoidable, but I’ve had too many cases with facts very similar to what I’m seeing right now. It would be irresponsible not to at least investigate further into red flags that glaring.
