Harris County, TX — January 9, 2024, David James Delgado was fatally injured and Jeffrey Nealy Jr. and another were hurt in a car accident at 4:35 a.m. on Sam Houston Parkway.
Authorities said in their statements that the crash happened along northbound lanes of East Sam Houston Parkway in the area of Woodforest Boulevard.
According to officials, 49-year-old David Delgado and 36-year-old Jeffrey Nealy Jr. were in a Dodge Avenger on northbound lanes. They were reportedly hit from behind by a Chevy Silverado. That driver allegedly fled the scene on foot, but it appears authorities identified the suspect.
Due to the crash, Delgado was taken to a hospital with serious injuries. Delgado later died on January 29. Nealy had injuries described as moderate as did the the driver of the pickup. Authorities allege that the pickup driver was under the influence of alcohol when the crash happened, but additional details are unavailable right now.

Hit-and-runs involving alcohol can prove uniquely challenging because it sometimes interferes with the ability of authorities to immediately record a drunk driver’s blood-alcohol content. If there’s separation between the accident and when the tests occur, it may muddy the waters. But despite how some may think, BAC is not the only important piece of evidence that can prove someone was intoxicated.
As a matter of fact, our firm has relied on all kinds of evidence besides a driver’s BAC to prove they were intoxicated. For example, we hold more bars and other alcohol providers accountable for their roles in drunk driving wrecks than just about any other firm in the state. When we do so, one thing we have to prove is that the person they served was obviously intoxicated. We’ve accomplished this using things like texts, social media posts, receipts, security footage, medical experts, and witness testimony. Many times, those kinds of details were enough to prove intoxication even without something like a blood or breath test.
With that in mind, my hope here is that as many avenues as possible were explored to prove what happened here and who all is responsible. That way, the victims and families involved here can know that all culprits responsible for their hardships are going to be held accountable.
