According to authorities, the Cadillac driver was under the influence of alcohol. If that’s true, where did that alcohol come from? If the driver was illegally over-served by a bar or some other alcohol provider, they, too, may be responsible for all of this. Negligent alcohol providers can face criminal investigations, fines, license suspensions, or liability for the injuries caused by a resulting accident.
Unfortunately, that’s something authorities often overlook. I’ve handled hundreds of civil cases against negligent alcohol providers. In far too many of them, authorities only investigated those alcohol providers because we brought the establishments to their attention following our own investigations. That means there are many victims and families out there who were harmed by a drunk driver who was over-served, and those negligent alcohol providers were simply let off the hook because authorities never looked for them, and the victims and families didn’t realize they had other avenues available to them under Texas law.
So following a crash like this, it’s important to be actively engaged with the authorities to understand what they’re looking into and whether or not there are questions they’re failing to answer. That way, if their efforts seem lacking, victims and families can take the appropriate steps to have independent investigators pick up the slack and get them the answers they deserve.
