Commentary by Attorney Michael Grossman

With single-vehicle wrecks, I rarely see authorities talk to the public about looking into things like mechanical defects, road hazards, medical emergencies, tire failure, or anything like that. Despite the fact it’s very possible for a crash like this to be unavoidable, all anyone ever talks about is the driver likely being to blame.

Don’t get me wrong—that is the most common explanation. It would be irresponsible to ignore possibilities like distracted driving, speeding, or drivers being over-served by a local bar, for example. But there’s no excuse for overlooking other possibilities just because they aren’t common. That’s why it can be frustrating to see how often even the authorities jump to conclusions. I can only hope they’re not leaving any unanswered questions here.
