Commentary by Attorney Michael Grossman

There isn’t much information about what happened here, and what details are available make this situation far from open-and-shut. There’s no law that says someone is or isn’t responsible if they’re stopped in a lane of travel. It’s about why they were there and what steps were taken (if any) to keep people safe.

I handled a case not long ago which shows just how reckless it can be to block a lane of travel. In that cases, a truck broke down on the highway. Through our independent investigations, we found records showing that the truck wasn’t being repaired routinely. The breakdown was all but inevitable. And when the breakdown did happen, the driver never bothered putting out cones or flares to ensure the obstruction was clearly visible. This led to a serious collision.

So reading these preliminary details, there are some crucial details missing which need to be cleared up. People lost their lives here, and their loved ones deserve to know how all of this could have been avoided.
