How Did This Accident Occur?
People tend to blame victims for being in the wrong place at the wrong time when it comes to fatal pedestrian-involved accidents on highways. However, I’ve had the opportunity to analyze hundreds of accidents like this one over the last thirty plus years. What I’m interested to know is whether or not there is enough pedestrian infrastructure in that area. Are there sidewalks and crosswalks that could have been used rather than the less-than-ideal route over the freeway lanes?
What about the driver? Given the time of night, driver distraction, fatigue, or even impairment might have had hand in the outcome. On top of that, what condition was the vehicle in? Did it have properly functioning headlights? Was it equipped with pedestrian detection that somehow malfunctioned at a critical moment? Were the brakes working properly, or did it experience brake failure?
All of these questions, and more, are things that authorities should be considering as they do their investigation. Should they, for whatever reason, appear to be shortsighted in their work, a third party investigation can always take up that slack. After all, the people left behind by Ariel Holmes deserve to have a detailed picture of how this accident occurred and why. Vague assumptions based on subpar, surface-level investigation just won’t cut it.
