Commentary by Attorney Michael Grossman
UPDATE (November 20, 2024): According to authorities, blood test results indicate that the victim of this accident may have been under the influence of alcohol at the time. I don’t mention that detail to tarnish her name in any way, only to help clarify at least one possible contributing factor. I still firmly believe the issues I mentioned in my original commentary should be evaluated as well, in case this like many accidents was due to multiple factors. I hope investigators took appropriate time and care to learn the whole story.
Speaking of investigators, if alcohol really was a factor then that means their work isn’t done. Now someone needs to find out where that alleged alcohol came from. Why? Because if a Houston business over-served that young woman, then it may deserve to face consequences under Texas dram shop law. If they kept selling or serving drinks to her long past her limits, they may be considered liable for the fatal injuries she suffered while impaired.
I want to be clear that I’m not pointing fingers at any specific Houston business. Not every alcohol-related accident involves a reckless bar, and I don’t know something police don’t. I just believe the possibility needs careful investigation, and soon. If a local business is playing fast and loose with the rules, and their carelessness helped end a young woman’s life, then they should absolutely be held accountable.
ORIGINAL: After an accident like this, it’s important not to jump to any conclusions before investigators can gather more facts. People sometimes try to fill in the blanks for themselves, and they may try to blame the victim since no one else was involved in the wreck. While authorities can’t rule out the possibility of driver error, it’s important to keep an open mind and consider other potential explanations. For example: Was the vehicle defective somehow? Did its airbags and seat belts work properly? What was the condition of the road? Was it well-lit at that time of night? How was the weather? Were there other extenuating factors the police may have overlooked?
At the end of the day, it’s important that even less-common possible factors get careful attention to ensure the whole story is learned. Otherwise something important could slip through the cracks, and the victim’s loved ones deserve to know they have the truth.
