How Did This Accident Occur?

When it comes to work accidents, answering “how” an accident happen can be a lot more challenging than people may realize. It’s not always just about whether or not workers at the scene made a mistake. There also needs to be consideration for the condition of their safety equipment—if they even had access to proper equipment. Did a defect lead to the accident? Was the victim properly trained? Were they forced to work unsafe hours? Did a worker from another company make a mistake, leaving dangerous conditions behind for the next worker to run into?

These are just some questions I’d expect to see from a proper work accident investigation. OSHA might look into that stuff, but it’s been months now, and their public reports on the situation offer little to no new details. Sometimes, they’re more open behind the scenes with the worker’s family. A lot of the time, though, families are just as in the dark as everyone else. That’s why many of them decide to bring in outside professionals who can help get some answers.

Considering Texas has the most complex work fatality laws in the whole country, getting those answers should always be a priority. Whether it’s OSHA or independent investigators, my hope is that steps are taken here to ensure the victim’s loved ones have a full understanding of what happened. That’s often the biggest first step that can help them navigate the legal maze that is Texas work fatality laws.
