Commentary by Attorney Michael Grossman
One of the major concerns with any fatal accident is that the victim isn’t around to tell their side of the story. That’s why it’s crucial there’s as much evidence as possible doing so in their stead. However, that’s not always a priority for the authorities.
It often surprises folks to find that authorities tend to focus only on looking for criminal activity. Then, they move on once that’s done. Meanwhile, there could be all kinds of crucial, time-sensitive evidence not getting the attention it needs. For that reason, independent accident reconstructions are often necessary in situations like this.
Regardless of what happened in the accident, families deserve to know they’re getting the full story. That means pulling vehicle data, looking for video footage, inspecting the vehicles for defects, looking at road conditions, examining where the drivers were coming from prior to the crash, lighting and signage, etc.
At the end of the day, the evidence needs to speak for itself, which means the prudent way forward is to gather as much evidence as possible. It remains to be seen if that ever happened here.
