Commentary by Attorney Michael Grossman

In my experience, both single-vehicle accidents and accidents involving teen drivers aren’t always taken seriously. It would surprise folks how often I get calls about similar crashes where it turned out authorities barely scratched the surface before moving on. That’s why it’s sometimes necessary to follow up with investigators as early as possible and ask some key questions.

  • Did authorities have the right tools and enough time to investigate properly?
Icy roads complicate accident scenes, and if investigators were rushed or ill-equipped, they may have missed critical evidence like skid marks, vehicle positioning, or road treatment conditions.
  • Was the vehicle inspected for potential defects?
Even when road conditions are a factor, mechanical issues like faulty brakes, traction control failures, or tire defects can also play a role. It’s also important to examine whether safety systems like airbags or seatbelts worked as intended.
  • Has all available electronic data been preserved?
Many vehicles log speed, braking, and steering activity that can clarify what happened. Authorities sometimes also aren’t thorough in pulling cell phone data. There could also be video of the crash from nearby residences or businesses.

If it seems authorities have worked diligently and can answer these questions, that’s good. But if it seems their investigations didn’t go deep enough, it may be that further independent investigations would reveal new details.
