Commentary by Attorney Michael Grossman
Motorcycle accidents are often challenging simply because of how many people are primed to automatically blame motorcyclists. It’s an all too common negative bias, and authorities sometimes let that bias affect their investigations. That’s why it’s so important victims and families are proactive and look at the sort of information authorities are coming forward with.
I handled a case a while back, for example, where a motorcyclist was blamed for speeding and weaving through traffic. The family knew the victim was a safe driver, so they wanted a second opinion. We were able to get witness testimony and physical evidence from an accident reconstruction which completely disproved the official story. Had those independent investigations not occurred, it’s likely the false claims against the victim would have stood.
Perhaps nothing like that is happening here. Authorities are certainly capable of conducting good, thorough investigations. It’s just important that people trust their instincts when they feel investigators aren’t taking their situation seriously. Otherwise, something important could slip through the cracks.
