Commentary by Attorney Michael Grossman

Authorities continue to allege that alcohol is a suspected factor in the crash, including that they recommended there be a charge for intoxication manslaughter against the wrong-way driver. That’s not all that surprising to see, considering it’s a common step for officials to take after a wrong-way crash. And if this situation is indeed similar to countless others I’ve seen over the years, it also wouldn’t be surprising if that’s as far as authorities took things. That could mean they’re missing an accomplice to all of this who has yet to be held accountable: a bar.

Put simply, the vast majority of wrong-way collisions at 2:00 a.m. involve extremely intoxicated drivers who were illegally over-served by a local bar. The stats are clear about that, and anyone with experience dealing with alcohol-related accidents knows this as well. Despite this reality, officers rarely get the time, equipment, or training needed to follow up on that sort of thing. Our firm has helped hundreds of families harmed by those kinds of negligent alcohol providers, and it’s shocking how often those folks never even knew there might be someone else out there responsible for their hardships until we asked them about it. Authorities never mentioned anything beyond the drunk drivers despite the fact it was the providers who over-served them that were continuing to put lives at risk.

My hope is the authorities here have been more thorough than those past cases I’ve seen and are ensuring that all parties responsible here face appropriate consequences. I’ve seen how alcohol providers that might otherwise continue putting lives at risk clean up their act once they’ve actually been held accountable for their actions. It would be such a shame if this was another circumstance where the victim’s loved ones weren’t getting the whole story.
